Terms of Service

These Terms of Service ("Terms") govern your use of Skemia, operated by AIT Consulting ("Skemia", "we", "us"), available at skemia.co.za and app.skemia.co.za (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using Skemia for an organisation, you confirm you are authorised to accept these Terms on its behalf.
The Service
Skemia helps business analysts turn a project's context into documents such as a business case, functional specification, and user stories, along with related registers and diagrams, with help from artificial intelligence. The Service produces first drafts and working aids, not finished professional deliverables.
Your account
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your password safe and for all activity under your account.
- An individual account is for one person. Team workspaces let you share access with members you add; every member of a team can see every project in that workspace.
- Tell us promptly at info@skemia.co.za if you believe your account has been compromised.
Free trial, subscriptions, and billing
- Free trial. New accounts get a 7-day free trial that allows one project, with no card required. When the trial ends you choose a plan to continue.
- Plans and payment. Paid plans are billed monthly or annually through Creem, which acts as the merchant of record for your purchase. That means Creem, not Skemia, is the seller on your invoice, and Creem collects and remits any VAT, GST or sales tax your country applies. Prices are shown on our pricing page in United States dollars and exclude those taxes, which are calculated and shown to you at checkout before you pay.
- Automatic renewal. Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time from your billing page; cancellation stops the next renewal and your paid access continues until the end of the current period.
- When access ends. If your trial ends without a subscription, or your subscription is cancelled or lapses, your account becomes view-only: you can still read and export your existing work, but you cannot edit it, generate new content, or use the assistant until you subscribe again.
- Refunds. You get a 7-day free trial with no card, so you can judge Skemia before paying anything. Beyond that, payments are non-refundable for partial periods except where the law says otherwise. If you were charged in error, or a fault on our side stopped you using a meaningful part of a period you paid for, contact us and we will investigate and refund where it is fair. Because Creem is the merchant of record, Creem may also refund you directly under its own buyer protection terms, and consumers in the United Kingdom and the European Union keep their statutory cancellation rights. - Price changes. We may change our prices. We will give reasonable notice before a change affects your renewals.
Your content
You keep all rights to the content you put into Skemia and to the documents generated from it ("Your Content"). You grant us a limited licence to store, process, and transmit Your Content only as needed to provide the Service to you, including sending the relevant parts to our AI provider to generate outputs you request. We do not use Your Content to advertise to you or sell it to anyone.
You are responsible for Your Content. You confirm you have the right to upload and use it, including any confidential or client information, and that doing so does not break any law or agreement you are bound by.
Acceptable use
You agree not to:
- use the Service for anything unlawful, harmful, or infringing;
- upload content you do not have the right to use, or that contains malware;
- attempt to access other users' data, break our security, or disrupt the Service;
- copy, resell, reverse engineer, or scrape the Service; or
- use the Service to build a competing product.
Artificial intelligence and no professional advice
Skemia's outputs are generated by artificial intelligence and can be inaccurate, incomplete, or unsuitable for your situation. They are drafts to work from, not professional, legal, financial, or business advice. You are responsible for reviewing, correcting, and deciding whether to rely on any output. Skemia is not liable for decisions you make based on the Service's outputs.
Intellectual property
We own the Service itself, including its software, design, and brand. These Terms do not give you any rights to our intellectual property beyond the right to use the Service as allowed here. As set out above, you keep the rights to Your Content.
Availability
We work to keep the Service available and reliable, but we provide it "as is" and do not guarantee it will be uninterrupted or error free. We may change, suspend, or discontinue features, and we will give reasonable notice of significant changes where we can.
Limitation of liability
To the fullest extent allowed by law, Skemia and AIT Consulting are not liable for any indirect, incidental, or consequential loss, or for loss of profits, data, or business, arising from your use of the Service. Our total liability to you for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded by law.
Indemnity
You agree to cover us against claims, losses, and costs arising from Your Content or from your breach of these Terms or of any law.
Termination
You can stop using the Service and close your account at any time. We may suspend or end your access if you break these Terms or use the Service in a way that risks harm to us or others. When your account ends, your right to use the Service stops; provisions that by their nature should survive (such as content ownership, disclaimers, and limitation of liability) continue.
Governing law
Skemia is operated by AIT Consulting, a business registered in South Africa, and these Terms are governed by South African law, with the South African courts having jurisdiction over any dispute.
This does not take away rights you have where you live. If the consumer law of your own country gives you protections that cannot be contracted out of, including any right to bring a claim in your local courts, those rights still apply and nothing in these Terms limits them. Where your purchase is processed by Creem as merchant of record, Creem's own terms also apply to that transaction.
Changes to these Terms
We may update these Terms from time to time. If we make a material change we will update the date above and, where appropriate, notify you. Continuing to use the Service after a change means you accept the updated Terms.
